1.1 The present terms and conditions (hereinafter Terms and Conditions) apply to the legal relationship arising between webshop onega.ee (hereinafter bombbar.ee) customers (hereinafter Buyer) and webshop bombbar.ee owner company BOMBBAR OÜ (hereinafter Seller) upon purchase of products from bombbar.ee webshop. The present Terms and Conditions establish the rights and liabilities of the Seller and the Buyer, their responsibilities, product acquisition, payment terms, delivery and reclamation procedures and general information about services provided by the Seller.
1.2 The Seller hereby reserves the rights to amend or supplement the present Terms and Conditions without prior notice. The changes will be published on bombbar.ee website and they become valid as of publication of the changes on onega.ee website. In case the order was submitted before the purchase terms and conditions became valid, the terms and conditions valid at the time of ordering will be applied unless provided otherwise by law or the present Terms and Conditions.
1.3 The Seller is in no way responsible for possible damages resulting from the Buyer not reading the present Terms and Conditions.
1.4 Additionally to the present Terms and Conditions, legal relationship between Parties arising from purchasing from bombbar.ee is governed by the legislation of the Republic of Estonia.
2.1 Personal data presented by the Buyer to the Seller is handled according to the Data Protection Law. Data is forwarded to third persons only on the consent of the Buyer or in cases provided for by law.
2.2 The Buyer is responsible for not disclosing his/her login information (e-mail address and password) to third persons. The Seller is not responsible for any damages resulting from disclosure of login information of the Buyer to third persons on the fault of the Buyer.
2.3 The Buyer is responsible for accuracy of the information he/she presents. The Seller is not responsible for any damages resulting from inaccuracy of information presented by the Buyer.
2.4 If information presented by the Buyer upon registration changes, the Buyer shall immediately update the information on bombbar.ee website. The Seller is not responsible for any damages resulting from inaccurate or outdated information presented by the Buyer.
2.5 The Seller has the right to immediately and without prior notice to limit or suspend access of the customer to onega.ee website and deny service provision to the Buyer, if the Buyer acts or fails to act with the purpose to undermine, violate, disrupt or disturb the operations of bombbar.ee webshop.
3.1 The currency in our online shop is EURO. All bombbar.ee webpage prices are VAT-inclusive.
3.2 bombbar.ee has the right to change price and product information; the changes are valid as of publication on bombbar.ee webpage.
3.3 Availability and price of products on bombbar.ee webpage may change. Changes are valid as of publication on bombbar.ee webpage.
3.4 We ship within 1-3 working days. In rare cases it might take up to 14 days to ship the goods.
4.1 Buyers can place on order via webpage ordering system and via e-mail info@ bombbar.ee (contact bombbar.ee).
4.2 If delivery of the order should not be possible, the Seller has the right to offer a possibility to the Buyer to choose another equivalent product. In case the Buyer does not want the offered replacement product, the order will be cancelled and if the order has already been paid for, the Seller will reimburse the payment to the Buyer within 7 business days to the Buyer’s banking account from which the payment had been made.
The steps for making a successful purchase:
1 Choose the product that you wish to order. By clicking on the button “add to chart”, the selected product automatically goes to your basket. 2 You can see the contents of your basket by clicking on the link “Your basket” at the top of the page. There you can change the quantity of the products and delete products from the list, if necessary. 3 Once you have completed the order, choose the delivery method and enter the shipping address.
4 Read the rules and tick off the agreement, click “place order”
5 Then choose the payment method and pay for the order. After completing the payment, make sure to click on the button “Return to the seller”.
6 The order will be processed after receiving the payment.
5.1 Contract of purchase and sale between the Buyer and the Seller is deemed valid when the Buyer has paid for the products to the banking account of the Seller or in cash to an authorised representative of the Seller.
6.1 The Buyer can cancel his/her erroneous order by informing the Seller via e-mail, telephone or other communication channels.
6.2 The order will be automatically cancelled if the Buyer has not paid for the products within three business days as of due date.

8.1 The Buyer can receive the products at the Seller’s office in Tallinn, Osmussaare 8 after the representative of the Seller has notified the Buyer that the purchased products have arrived at the office.
8.2 If requested, the products will be delivered to the Buyer with a post machine. In such case, delivery fee will be added to the price of the products according to the pricelist available on bombbar.ee website.
8.3 The Seller is not responsible for possible delivery delay of the products and any resulting damages.
9.1 You can exchange and return products purchased in the online store Bombbar.ee an item in 14 days, counting from the moment the package was received. Returns are accepted only if the goods are unused, the packaging is closed and free from defects or traces of operation.
9.2 To return or exchange goods, please contact the manager by phone +372 58072180 and agree on details.
9.3 The reimbursement of the purchase amount for the returned goods is made at the earliest opportunity, but not later than within 14 working days from receipt of the goods at the return address. Shipping costs associated with returning the goods are paid by the customer.
9.4 If you find that we have sent you a poor-quality product, or mistakenly sent you the wrong product or product of the wrong size, please return this product immediately. In the case of sending a poor-quality or incorrect product, we will return the cost of the goods to you as soon as possible, but no later than within 14 business days.
9.5 In the case of a replacement item, we will send you a replacement item immediately, as soon as the item to be replaced is delivered to the return address. Due to changes in stock status, Bombbar.ee cannot always guarantee the possibility of replacing the goods. To replace the product, select a replacement product (after making sure that it is available in the online store) and send a request for a replacement, coordinating it with the manager.
9.6 In the conditions of preferential campaigns or if the goods are made according to the client’s personal requirements we offer the possibility of returning or replacing goods only if the purchased goods turned out to be defective or suffered during transportation.
9.7 Since, prior to receiving a BombBar OU parcel, you cannot assume responsibility for the goods, we recommend that you select the registered mail service when you make a return. Be sure to save the document received when sending the parcel as proof of shipment.
9.8 The Buyer accepts the possibility that in case of abuse of the right to terminate the contract of sale, the Seller has the right to refuse to service the Buyer.
9.9 The right of return is not applied if a legal entity acts as a buyer.

10.1 Disputes between the Seller and the Buyer are solved by negotiations. If a mutual agreement cannot be reached, the Parties are entitled to take the matter to the Consumer Protection Board or Harju County Court. Solving of disputes is governed by the legislation of the Republic of Estonia.
